CHAPTER I GENERAL PROVISIONS
[Article 1 (Purpose)]
The purpose of this Policy is to stipulate the rights, duties and responsibilities of the members of KTR Chemical Safety Assessment Center (hereinafter referred to as “Chemical Safety Assessment Center”) and other necessary matters.
Article 2 (Definitions)
The terms used in this Policy have the following definitions:
- (1) The term “member” means a person who agrees to this Policy, who provides his/her personal information to the Chemical Safety Assessment Center, who is issued an ID (unique number) and password to register as a member, who continuously provides information of the Chemical Safety Assessment Center, and who can use the services provided by the Chemical Safety Assessment Center.
- (2) The term “ID” means a specific combination of alphanumeric characters selected by the person applying to use the services for identification of the member and assigned by the Review and Assessment Service.
- (3) The term “Password” refers to a specific combination of letters and numbers selected by the member to confirm that he/she is a member matching the assigned ID and to protect the member’s confidentiality in communication.
Article 3 (Changes to the Terms and Conditions)
- (1) This Policy shall take effect by announcing or notifying members using a partial screen of the services or other methods.
- (2) The Chemical Safety Assessment Center may change this Policy if there is an unavoidable reason for the operation of the services, and the changed Policy shall take effect by announcing or notifying the member in the manner provided in paragraph (1).
- (3) Members may request to withdraw from membership if they do not agree to the changed Policy, and if they continue to use the service after the effective date of the changed Policy, they shall be deemed to have agreed to the changed Policy.
Article 4 (Extralegal Norms)
Matters not specified in this Policy shall be governed by the Personal Information Protection Act of the public institutions, the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulations of the Information and Communication Ethics Committee, the Information and Communication Ethics Norms, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, other relevant laws and regulations, and guidelines set by the Review and Assessment Service.
[CHAPTER II ESTABLISHMENT, MODIFICATION AND TERMINATION OF THE AGREEMENT]
Article 5 (Establishment of the Agreement)
- (1) The Agreement for the use of the services provided by the Chemical Safety Assessment Center shall be established when the member agrees to this Policy and completes the entry of personal information and other required information on the prescribed application form provided on the website of the Chemical Safety Assessment Center.
- (2) All information entered by the member shall be deemed to be true, and members who do not enter their real name or real information may not receive legal protection and may be restricted from using the service.
Article 6 (Modification to the Agreement)
- (1) The member shall immediately request a change to the Chemical Safety Assessment Center if there is a change in any of the following items:
- 1. Personal information registered when applying for the service, such as address (including postal code) and telephone number (work, mobile phone);
- 2. Other security devices such as passwords.
- (2) Notwithstanding the provisions of paragraph (1), the member’s ID cannot be changed, and if a member wishes to change it, he/she must apply for withdrawal from membership and reapply for membership.
Article 7 (Termination of the Agreement)
- (1) The member may request the Chemical Safety Assessment Center to terminate the Agreement at any time, in which case the Chemical Safety Assessment Center shall terminate the Agreement without delay.
- (2) The Chemical Safety Assessment Center may terminate the Agreement ex officio if it is determined that the use of the service is impossible due to reasons such as the death of the member.
[CHAPTER III USE OF SERVICES]
Article 8 (Use of Services and Notification)
- (1) Members may select and use only some items of the services provided by the Chemical Safety Assessment Center.
- (2) In providing services, the Chemical Safety Assessment Center may post various information on the Notice page, or provide it individually using methods such as hyperlinks or emails registered with the Chemical Safety Assessment Center.
- (3) If it is necessary to notify an unspecified number of members, the Chemical Safety Assessment Center may substitute individual notifications by posting the items to be notified on the Notice page for more than one week.
Article 9 (Service Hours and Suspension)
- (1) The use of the service shall be 24/7, 365 days a year, unless there are special reasons for business or technical reasons: Provided, That the Chemical Safety Assessment Center may suspend the service when there is an unavoidable reason, such as the need to maintain and inspect the system related to the service or urgently supplement it.
- (2) In the case of proviso to paragraph (1), the reason for the suspension of the service and the period of suspension shall be announced in advance, except in unavoidable cases.
Article 10 (Suspension of Service Use)
In case where a member does not use the Service for a long period of time, the Chemical Safety Assessment Center may suspend the use of the service when six months have elapsed from the date of the last use of the service.
Article 11 (Storage of Data, etc.)
- (1) The Chemical Safety Assessment Center shall not be liable if the contents of data, messages, etc. transmitted by the member do not arrive at the Chemical Safety Assessment Center or are not stored due to national emergencies, power outages, service equipment failures outside the scope of management of the Chemical Safety Assessment Center, or other force majeure reasons, and if there is any loss of other communication data.
- (2) The Chemical Safety Assessment Center shall keep the data transmitted to the member for 90 days from the date of transmission, and may delete the data already transmitted if the same period has elapsed or if it is determined that the member has not received or viewed the transmitted data for a considerable period of time, which may cause a failure in the computer equipment system.
- (3) The Chemical Safety Assessment Center shall not be liable for any data deleted pursuant to the provisions of paragraph (2).
Article 12 (Management of Dormant Accounts)
- (1) The Chemical Safety Assessment Center shall regularly manage dormant accounts in order to block spam emails delivered to members and reduce the waste of unnecessary computer capacity if members do not use the service for a long period of time.
- (2) In accordance with the provisions of paragraph (1), if a member does not use the service for more than six months continuously from the date of registration, the Chemical Safety Assessment Center may delete the materials stored in the mailbox, and may stop providing and using the service.
Article 13 (Attribution of Copyright and Restriction of Use)
- (1) The intellectual property rights and other rights related to the services provided by the Chemical Safety Assessment Center, the software required to provide the services, the names and information of the services, etc. shall be retained by the Chemical Safety Assessment Center.
- (2) Members shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes, or cause a third party to use information obtained by using the services provided by the Chemical Safety Assessment Center without the consent of the Chemical Safety Assessment Center.
- (3) The Chemical Safety Assessment Center may delete all information related to the service without the consent of the member if it is determined that the member has clearly violated the relevant laws or this Policy.
[CHAPTER IV OBLIGATIONS OF THE PARTIES]
Article 14 (Obligations of the Chemical Safety Assessment Center)
- (1) The Chemical Safety Assessment Center shall manage the website so that safety and reliability can be ensured in accordance with relevant laws and regulations and this Policy, and shall strive to provide the service continuously and stably.
- (2) The Chemical Safety Assessment Center may not use the member’s personal information acquired in connection with the provision of the service for any purpose or provide it to a third party without the member’s consent.
- (3) The Chemical Safety Assessment Center shall establish a security system to protect the members’ personal information so that members can use the service safely.
Article 15 (Obligations of Members)
- (1) A Member shall not engage in any of the following acts in connection with the use of the service:
- 1. Fraudulently using another member’s ID and password;
- 2. Using the service in connection with a crime;
- 3. Acts that damage the honor of others or cause disadvantage to others;
- 4. Registering or distributing computer viruses, spam emails, etc. that cause malfunction of facilities related to the service or destruction or confusion of information, etc.; or
- 5. Acts that violate other related laws and regulations.
- (2) Members shall comply with the matters stipulated in this Policy and the service use guidelines or precautions, and shall comply with the matters announced or separately posted by the Chemical Safety Assessment Center.
- (3) For the smooth use of the service, the member shall read the e-mail at least once every day in order to receive the data transmitted by the Chemical Safety Assessment Center in a timely manner. In this case, the Chemical Safety Assessment Center shall not be liable for any damages caused by the member’s failure to read the e-mail from time to time.
- (4) Members may not transfer or assign the right to use the service or other contractual status to others, or provide it as collateral.
[CHAPTER V SUPPLEMENTARY PROVISIONS]
Article 19 (Compensation for Damages)
Members shall compensate the Chemical Safety Assessment Center for damages caused by their illegal acts.
Article 20 (Indemnification)
- (1) The Chemical Safety Assessment Center shall be exempted from liability for providing services if it is unable to provide services due to natural disasters or equivalent force majeure.
- (2) The Chemical Safety Assessment Center shall not be liable if there is an obstacle to the use of the service due to the reasons attributable to the member.
- (3) The Chemical Safety Assessment Center shall not be liable for any damages caused by the member’s failure to timely receive or view materials transmitted from the Chemical Safety Assessment Center.
Article 21 (Jurisdiction)
- (1) In case where a dispute arises between the Chemical Safety Assessment Center and a member in connection with the use of the services, they shall consult in good faith to resolve it through mutual consultation as much as possible.
- (2) In case where the dispute is not resolved despite the provisions of paragraph (1) and is unavoidably resolved by litigation, the Chemical Safety Assessment Center shall file a lawsuit with the court having jurisdiction over its location.
